he Constitutional Court ruled in favor of the Union of Democratic Forces of Guinea (UFDG), which had seized it with a request dated October 14 concerning the delivery of a legible copy of a copy of the minutes of the  counting of the provisional results of the presidential election of October 18.
Cornered by the UFDG, the Independent National Electoral Commission (CENI) which says it is not able to give a copy of the report to each delegate of candidates, had told the members of the polling stations to hand over the sixth copy of the trial  -verbal to the representative of the political party having obtained the most votes in the polling station concerned.
The institution made it clear that the representative to whom the sixth copy will be given must go to the headquarters of the CEPI within the country and the CECIs in Conakry to make copies for the other representatives of the candidates.  An approach contrary to the legislation in force.
In its order of October 16, the Constitutional Court ordered the CENI to `` take and cause to be taken all the necessary measures to give each candidate's representative a legible photocopy of the minutes of the counting of the provisional results in accordance with the ''  spirit 85 paragraph 4 of the Electoral Code to the deliberation of the CENI of October 15 ''.
This, we read, in application of article 2 paragraph 3 of the Electoral Code which states that "The courts and tribunals ensure the regularity of the elections, settle electoral disputes and prescribe all measures they deem useful for the proper conduct of the elections.  elections ”.
She motivates her order by the need to "guarantee the transparency of the presidential election of October 18".
